Qodo Acceptable Use Policy

This Acceptable Use Policy (“AUP“) supplements the Qodo General Terms of Service, Qodo Business Terms of Service or any other agreement or order form between you and Codium Ltd. or its affiliates (dba Qodo) governing the use of Qodo’s Platform, Software, Website, Services or other products and services (each of the foregoing, together and separately, the “Agreement“). The AUP applies to your access and use of the Services, Customer Data (including the Input you provide to the Services and the Output generated by them), whether as part of the Services or your use outside of them. Capitalized but undefined terms used in the AUP have the meanings set forth in your applicable Agreement with Qodo.

You will not share with the Services any Input that, nor knowingly use the Services to generate any Output that or use any Output generated by the Services that:

  • Is defamatory, obscene, violent, hateful, racist or discriminatory, pornographic or is otherwise offensive.
  • Infringes on any patent, trademark, trade secret, copyright, or other intellectual property or other proprietary rights of any other person.
  • Violates the privacy rights of any individual or is otherwise in violation of Qodo’s Privacy Policy or the DPA (if any) between us.
  • Is reasonably likely to defraud any person.
  • Promote any illegal activity, or advocate, promote, or assist any unlawful act.
  • Impersonate any person or misrepresent your identity or affiliation with any person or organization, including Qodo.
  • Contains, transmits or otherwise makes available any malicious code, including any virus, worm, trojan horse, time bomb, web bug, spyware, or any other malicious or harmful computer code, file, or program.

To the extent the Services generate Output containing any of the above, you will notify us in writing without undue delay upon becoming aware of it.

Enforcement of the AUP, including the determination whether a violation occurred, is at Qodo’s sole and absolute discretion, and failure to enforce it in one instance does not constitute a waiver to enforce it in other instances. You will promptly cease use of any Customer Data or Output violating this AUP, and Qodo has the right to promptly remove or delete any violating Customer Data from the Services in its sole discretion or modify the Services to ensure compliance with the AUP.
